Mr. Avijit Chakraborty ...for the petitioner Mr. Ashim Kumar Ganguly, Mr. Bellal Sheikh ...for the State The innocuous prayer of the petitioners is a consideration by the Chief Engineer (South Zone), P.W. (Roads) Directorate, of the communication dated September 04, issued by the Executive Engineer, Nadia Highway Division No. 1, P.W. (Roads) Directorate to the said Chief Engineer, regarding construction of a culvert at the behest of the petitioner no. 1-Institute. Learned counsel appearing for the respondent-authorities files a report indicating that there are several objections and issues pending in connection with the construction of such culvert, including allegations that such construction is illegal.

Whatever may be the stand taken by the objectors to the construction of the culvert, the Chief Engineer, being the respondent no. 2 herein, has to consider the same upon giving opportunities of representation to the objectors as well as to the petitioners and to come to a conclusion on the said issue expeditiously, more so, since the petitioner no. 1 is a primary teachers' training institute, where delay may affect the careers of the students therein.

Accordingly, W.P.A. No. 47 of 2021 is disposed of by directing the respondent nos. 2 and to consider and decide on the communication dated September 04, 2019, annexed at page 19 (Annexure P-2) of the writ petition, upon giving opportunities of representation/hearing, as it deems fit, to all the interested parties, including the petitioners, and to decide upon the same within one month from date.

and shall, immediately upon arriving at such decision, communicate the same to the petitioners.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the

parties upon compliance of all necessary formalities.
