The writ petitioner is represented.

The affidavit of service has been filed, the same is kept on record. It appears that the copy of the writ petition has duly been served upon the respondent no.2 and also the State.

In the present writ petition, the writ petitioner Bank claims that despite requests being made to the respondent no.2 to take necessary step for providing assistance to the Bank to take possession of the secured assets under the relevant provisions of the Securitisation and Reconstruction of financial Assets and Enforcement of Security Interest Act, 2002 read with the relevant Rules framed thereunder, the concerned District Magistrate did not take any step. Today, when the matter has been called on it is submitted and confirmed by the learned Advocate appearing for the writ petitioner Bank that after filing the writ petition the concerned District Magistrate has taken steps in accordance with law and as such the present writ petition has lost its force.

In view of the above, the present writ petition being WPA 48 of 2021 stands dismissed as infructuous.

However, it is made clear that merit of the said writ petition has not been gone into.

Accordingly, WPA 48 of 2021 stands disposed of. (Aniruddha Roy, J.)
