Despite service, none appears for the respondents when the matter is taken up for hearing. Although no separate notice of upgradation appears to have been given to the respondents, the same is deemed unnecessary in view of the innocuous nature of the prayer made by learned counsel for the petitioner.

An application under Section 14(1) of the SARFAESI Act was made by the petitioner before the District Magistrate, Paschim Bardhaman, which has been kept pending for an inordinately long period. There appears to be substance in such contention of the petitioner, as it appears from the materials on record.

Accordingly, WPA 49 of 2021 is disposed of by directing respondent no.2 to dispose of the application of the petitioner under Section 14(1) of the SARFAESI Act, as annexed to the present writ petition, as expeditiously as possible, preferably within two months from the date of communication of this order to respondent no.2.

The petitioner shall communicate this order, along with a fresh copy of the writ petition, to the respondent no.2 at the earliest to ensure due compliance of this order.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
