The prosecution in connection with Canning Police Station case no. 91/19 dated 25.02.2019 which was registered for investigation under Section 304/34 of the Indian Penal Code intends to examine 31 witnesses to prove its case and till date only one witness has been examined.
Having considered the fact that more than five years have passed since the initiation of the instant case, I direct the learned trial Court on and from next date to fix at least a schedule consisting of three dates and the schedule be fixed once in every 30 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties. The DSP/SDPO/Additional SP/In-charge of Canning PS would act as Nodal Officer and take steps that all the witnesses so summoned do appear before the Court on the date so fixed.
The learned Public Prosecutor conducting the case would produce materials, exhibits and documents on the date so fixed for examination of witnesses. All stakeholders would cooperate with the learned trial Court to conclude the trial at the earliest. With the aforesaid observations CRR 6 of 2024 is disposed of. Report so submitted by the State be kept with the record. Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
