Heard learned advocates appearing for the parties. By this writ petition, petitioner has made prayer for direction upon the respondent no.4 to take steps to implement the observation made in the enquiry report dated 8th January, 2022 and 19th July, 2022 before proceeding any further for holding annual general meeting of the board. It is submitted by the petitioner that the aforesaid enquiry report was conducted and held by the Assistant Registrar concerned on the basis of the direction of the Registrar Co-operative Society himself as such the observation made in the aforesaid enquiry report is liable to be taken into consideration.

Considering the submission of the parties, this writ petition being WPA 62 of 2023 is disposed of by directing

the respondent no.4 to take into consideration the observation made in the aforesaid enquiry report and till such consideration, no annual general meeting scheduled to be held on 8th January, 2023 shall be taken place and the meeting of the board already held on 2nd January, 2023 will also abide by the subsequent steps to be taken by the respondent no.4 in implementing the observation made in the aforesaid enquiry report. Before taking any further step in the matter, respondent no.4 shall give opportunity of hearing to the interested parties affecting their rights.

With this observation and direction, this writ petition being WPA 62 of 2023 is disposed of. (Md. Nizamuddin, J.)
