The writ petition has been mentioned for upgradation citing urgency that the petitioners are starving. The submissions are a pack of lies. The order of which non-compliance is alleged is dated August 17, 2019 passed by the learned Civil Judge (Sr. Div.), 1st Court, Baruipur in T.S. No. 221 of 2016. There is absolutely no explanation in the writ petition as to what the petitioners were doing from 2019 to January 2022 in the face of alleged inaction by the police. The learned Civil Judge shall take note of the same while passing any further orders.

In the meantime, this Court notes with anguish the utter failure on the part of the Officer-in-Charge, Kultali Police Station in submitting any report to the Civil Judge (Sr. Div.), 1st Court, Baruipur. There is no plausible explanation as to why any report could not be

submitted by the Officer-in-Charge, Kultali Police Station for nearly three years now.

This Court is of the view that the matter should be enquired into by the Superintendent of Police, South 24 Parganas. The S.P., after enquiry, shall take suitable steps against the concerned Officer-in-Charge, Kultali P.S., who appears to have deliberately and willfully refused to submit any report to the concerned Civil Court.

The Registry of this Court and the petitioners shall communicate a copy of this order to the Superintendent of Police, South 24 Parganas and the Civil Judge (Sr. Div.), 1st Court, Baruipur.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
