He prays for inclusion of the name of his youngest son as partner in the fair price shop cum S.K. Oil dealership on account of his physical incapacitation.

According to the petitioner, the same is permissible in view of the amendment incorporated in the West Bengal Public Distribution System (Maintenance and Control) Order, 2013 on 14th December, 2020.

has submitted a representation before the Sub-Divisional Controller (Food & Supplies), Kandi, Murshidabad on 13th December, 2021 and alleges that the same has not been considered till date.

As it appears that the representation filed by the petitioner is pending consideration at the end of the respondent No. 4 accordingly, the instant writ petition is disposed of by directing the respondent No. 4 to consider and dispose of the representation filed by the petitioner on 13th December, 2021, strictly in accordance with law, at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner no. 1 immediately thereafter.

The petitioner is directed to forward a copy of the representation dated 13th December, 2021 along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
