1. Let affidavit of service, as filed in Court, be kept on record.

During the course of argument, Mr. Nandi, learned Advocate appearing for the Union of India, hands up a copy of the communication from the Registrar of Indian Institute of Technology, Kharagpur, (in short "IIT, Kharagpur"), wherefrom it appears that the petitioner has already been confirmed to her post in IIT, Kharagpur, on successful completion of her probation period, a copy of which, as produced in Court, is kept on record.

3. In view of the aforestated, the present writ petition has become infructuous.

4. Ms. Banerjee, learned Advocate appearing for the petitioner, on instructions, seeks leave to withdraw the writ petition.

The writ petition is, thus, dismissed as withdrawn.

6. There shall, however, be no order as to costs.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
