Petitioner prays for expeditious disposal of an application for injunction which is pending before the learned Additional Civil Judge (Junior Division), 1st Court at Alipore in Title Suit no.1126 of 2024.

According to the petitioner, the High Court by an order dated August 29, 2024 passed in CO 3049 of 2024, had directed the learned Trial Judge to dispose of the application for injunction as expeditiously as possible without granting any unnecessary adjournments. It is contended by the petitioner that despite such direction, the learned Court has not proceeded with the matter. 3.

It appears from the last order annexed to this revisional application that the Court awaits service return.

Under such circumstances, the revisional application is disposed of with a request to the learned Trial Court to ensure expeditious disposal of the application for injunction upon making a special endeavour as regards service of the summons upon the opposite parties in all possible modes. The petitioner may also serve a copy of the plaint and injunction application upon the opposite parties and file the service return before the Trial Court by way of an affidavit.

Accordingly, CO 12 of 2025 stands disposed of. 6.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
