This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by non-consideration of his representation dated September 10, for compassionate appointment by the District Inspector of Schools (S.E.), Berhampore, Murshidabad (hereinafter referred to as the 'D.I.').

The petitioner submits that the school authority has forwarded the application for compassionate appointment to the D.I. However, no action on the same has been taken till date.

Learned counsel appearing on behalf of the respondents State submits that the concerned authorities should decide this matter after granting an opportunity of hearing to the petitioner.

I have heard counsel appearing on behalf of the parties and perused the materials on record.

In light of the submissions made, I direct the concerned authorities to grant an opportunity of hearing to the petitioner and thereafter, pass a reasoned order within a period of four weeks from the date of communication of this order. The reasoned order should be communicated to the petitioner within a week of passing of the same.

In the event the order is in favour of the petitioner, the respondents authorities are directed to ensure expeditious implementation of the same.

With the above direction, the writ petition is disposed of. There will be no order as to costs. 8.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
