The subject-matter of the revisional application relates to continuation of investigation relating to Kotulpur P.S. Case No. 182 of 2023 dated 22.6.2023.

I have perused the documents which have been enclosed along with the revisional application and I find that that, at this stage, the investigation of the case is continuing and the ld. Magistrate in seisin of the matter is aware regarding the same as he has called for I.O.'s report. Records of the case reflect that the petitioner has been granted anticipatory bail and there are some versions of the present petitioner but the same relates to question of facts.

In view of the nature of offence complained of, this court, at this stage, do not intend to enter into the truth or falsity of the contention so advanced.

However, it would be for the investigating agency to arrive at their conclusion at the stage of section 173 of the cr.p.c.

The petitioner would be at liberty to approach this court, if at all required, after the report under section 173 of the cr.p.c. is filed and the documents under sections 207 of the cr.p.c. is supplied to him.

With the aforesaid observations, CRR 9 of 2024 is disposed of.

Pending application (s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
