The petitioner is a Trade Union that represents at least 5,000 workers in the jute industry. Since the year 2015, they have participated along with 22 other Trade Unions in all negotiations with the jute mill before the Labour Commissioner and other authorities of the Government of West Bengal.

They continued to participate upon being invited by the Additional Labour Commissioner until August 29, 2023.

However, in a notice dated October 16, 2023, for holding "Tripartite Meeting on the

Industry wise Charter of Demand on Jute, the Additional Labour Commissioner, Government of West Bengal has not invited the petitioner.

The petitioner has represented in this regard to Labour Ministry of the State on October 30, 2023 but has received no response.

Since the petitioner wants to participate in the deliberations before the Additional Labour Commissioner as they have been participating since 2015, this Court in the interest of justice directs the Additional Labour Commissioner, Government of West Bengal to allow the petitioner to participate along with other trade unions in the tripartite deliberations of industry wise charter of demand on jute, that is presently ongoing.

It is submitted by the learned counsel for the petitioner that there are some deliberations being held today.

The petitioner may participate in the tripartite deliberations from today itself.

Counsel for the State and the petitioner shall communicate the gist of this order on their letterhead to the Additional Labour Commissioner.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

12.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
