Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that contraband substance above commercial quantity was recovered from the joint possession of the petitioner and as such, the rigours of Section 37 of the NDPS Act is attracted. The petitioner's earlier prayer for bail was rejected on 19th August, 2021 and we do not find any substantial change in the circumstances thereafter. In view thereof, the petitioner's prayer for bail is refused at this stage. Mr. Bagchi, learned advocate appearing for the petitioner, however, submits that the petitioner is languishing in custody for 555 days and there is also no possibility towards early conclusion of the trial. Answering our query, Mr.

Sur, learned Additional Public Prosecutor informs this Court that charges have already been framed and 3rd March, 2022 has been fixed for evidence. In view thereof, we request the learned court below to expeditiously conduct the trial so that logical conclusion of the case may be reached at the earliest. The application for bail being CRM(NDPS) No.9 of 2022 is, accordingly, disposed of.
