The Internal Complaints Committee of Netaji Satabarshiki Mahavidyalaya found the petitioner not guilty of the allegations made by respondent no. 4 against him.

Respondent No. 4 preferred an appeal before the appellate authority being respondent no. 2 against the said order.

It is the case of the petitioner that respondent no. 2 had no jurisdiction to entertain the appeal.

The appellate authority also ultimately by an order dated January 19, 2023 disposed of the appeal observing that it had no authority to adjudicate the appeal. Respondent no. 4 submits that already a writ petition being WPA 2009 of 2023 has been filed before

this Court challenging the said order of the appellate authority dated January 19, 2023.

In that view of the matter, I am of the opinion that there is no justification to keep this writ petition pending since this writ petition has become infructuous. Accordingly, WPA 81 of 2023 stands disposed of. ( Kausik Chanda, J.)
