CIVIL APPELLATE JURISDICTION SA No. 1455 of 1968 Mohon Chandra Mondal -versus- Narayan Chandra Mondal (since deceased) Kalipada Mondal & ors.

None appears on behalf of the appellant. The respondents are also not represented.

Seen the office report dated February 25, 2022 which indicates that the appeal is ready as regards service. But no paper book has been filed till date. It further appears from the said report that the exhibited documents were taken back by the defendants but not yet filed besides other anomalies on the record.

The appeal is pending since 1968. No steps have been taken by the appellant during this long period to make the appeal ready for hearing, which signifies that the appellant has lost his interest to proceed with the appeal.

The appeal being SA No. 1455 of 1968 is therefore dismissed without any order as to costs.

Interim order, if there be any, stands vacated. The department is directed to send down the connected lower Court records immediately.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
