Kausik (Rejected) CRM (M) 58 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Farakka Police Station Case No. 384 of 2024 dated 12.11.2024 under Sections 179/180/3(5) of Bharatiya Nyaya Sanhita, 2023. And In the matter of : Beerendra Sharma @ Biren Sharma ......Petitioner.

Learned advocate appearing for the petitioner submits that the petitioner was arrested on 12.11.2024 and till date he is in custody. Records of the case reflect that charge sheet was submitted on or about 25th January, 2025. There has been no progress in the case as one of the accused person is absconding.

In view of the period which has lapsed since January, 2025, I direct the learned Magistrate to take steps for committal of the present case within 30th April, 2026.

If the learned Court is of the opinion that the absconding accused cannot be traced, in that case, it would be

the discretion of the Court either to segregate the case or in the alternative, pass necessary directions for trial in absentia. Having regard to the quantum of seizure and the manner in which the progress of the case presently is proceeding, I direct that after committal of the case by 30th April, 2026 the learned Special Court would within a period of 45 days take steps for overcoming the stage of consideration of charges.

Petitioner would be at liberty to approach this Court after the aforesaid stage is over.

With the aforesaid observations CRM (M) 58 of 2026 is dismissed at this stage.

Report submitted by the State be kept with the record. A copy of the same be handed over to the learned advocate appearing for the petitioner.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
