akb Mr. Uttiya Ray ...For the Petitioner Ms. Koyeli Bhattacharya ...For Respondent West Bengal Board of Secondary Education This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the delay in concluding the disciplinary proceedings that have been initiated against him.

Ms. Koyeli Bhattacharya, learned Counsel appearing on behalf of the West Bengal Board of Secondary Education submits that the enquiry officer has been appointed and the proceedings are started.

In the light of the above submission, I am of the view that since suspension was done in the year 2018 and the charge sheet was submitted in the year 2019, the proceedings should conclude at the earliest.

Accordingly, the Disciplinary Authority of the West Bengal Board of Secondary Education is directed to conclude the proceedings within a period of three months from date. The petitioner is directed to cooperate and to be present whenever called for to assist in the said proceedings. I make it clear that I have not gone into the merits of the case and the respondent Authorities shall be at liberty to proceed in accordance with law subsequent to conclusion of the said proceedings.

With the above observations, this writ petition is

disposed.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.
