Ms. Ujjaini Chatterjee........for appellant Ms. Chatterjee, learned advocate appears and submits, she has since received information that sole appellant died sometime in year 2014. She has written letters to the legal representatives and received telephonic instruction that they are not willing to take steps and thereafter prosecute the appeal.

In view of the above, it is clear that the appeal has abated.

F.M.A. 1009 of 2009 is dismissed.
