The petitioners are aggrieved that Raidighi Police Station has not enquired into the FIR No.312 of 2021 dated 19th August, 2021.

Counsel for the petitioners submits that the private respondents and other miscreants are disturbing the possession of the petitioners and are vandalizing their properties.

Counsel for the State produces instructions of Raidighi Police Station as well as local Block Land & Land Reforms Officer.

This Court finds that the land on which the petitioners have their residence is Government property and belongs to the Public Works Department. This Court also finds that the proceedings under Section 107 and 116(c) of the Code of Criminal Procedure have been drawn up.

The Public Works Department, however, may take steps to take possession of the property that belongs to them in accordance with law.

The reports of the Inspector-in-charge, Raidighi Police Station and the Block Land & Land Reforms Officer, Mathurapur-II, South 24 Parganas are kept with the records.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
