1. This writ petition has been filed as Public Interest Litigation to direct the respondents to take action against the persons who are allegedly filling up a water body. In this regard, representation has been given and since the writ petitioner did not receive any response to the representation and upon failure of the Block Development Officer, Rajarhat, North 24 Parganas to act on the representation dated 13.12.2022, the present writ petition has been filed.

2. Learned counsel appearing for the petitioner submits that he has instructions to withdraw the instant writ petition but, however, he does not know as to what is the reason behind the instructions given by the writ petitioner to withdraw the writ petition. In any event, we cannot permit a Public Interest Litigation to be withdrawn as there may be other reasons which prompted the writ petitioner to withdraw the same.

3. Therefore, while rejecting the request made by the petitioner to withdraw the writ petition, we direct the District Magistrate, Barasat, North 24 Parganas to examine the representation dated 13.12.2022 and call for a report from the Block Development Officer, Rajarhat, North 24

Parganas and take action in accordance with law.

4. With the above directions, the writ petition stands disposed of.
