The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with NDPS Case No. 78 of 2020 arising out of Kaliachak P.S. Case No. 763 of 2020 dated 04.10.2020 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

The learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated and he is in custody for about 107 days. In view thereof further detention of the petitioner is not necessary. The learned advocate appearing for the State opposes the petitioner's prayer.

Having heard the learned advocates and considering the materials in the case diary and as contraband substance, above the commercial quantity, was recovered from the petitioner, we are not inclined to grant bail. The application for bail, being CRM 58 of 2021, is, thus, rejected.
