Learned advocate appearing for the petitioner submits that the petitioner is in custody for 138 days and although there was recovery of 515 grams of brown sugar from another accused, but the petitioner has been detained on the basis of statement of the co-accused and there are no materials to substantiate the involvement of the petitioner. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that CDRs revealed communication between the petitioner and the accused from whom seizure has been effected. On query, the learned advocate submits that the seizure was on 23.08.2025 and the CDR period is of a prior period. However, the investigation of the case is still in progress and the investigating agency is trying to unearth the materials.

Be that as it may, if there are no further materials collected so far as the present petitioner is concerned, learned Special Court would release the petitioner on bail after the charge-sheet is submitted.

However, the petitioner is also at liberty to exhaust the provisions of default bail, if the charge-sheet is not submitted within the statutory period.

With the aforesaid observations, the application for bail, being CRM (NDPS) 34 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
