The grievance of the petitioners in this present public interest petition is as against alleged plying of the heavy and loaded vehicle through the road under Atharakhai Gram Panchayat, District-Darjeeling and also illegally damaging part of the river beds of Balson river near the area under the said Gram Panchayat. Learned counsel for the State has submitted that though along with the petition several representations are filed, but if a representation is made to the respondent no.2 i.e. District Magistrate, Darjeeling, then the petitioners' grievance can be duly looked into by the respondent no.2. To this learned counsel for the petitioners has no objection.

Hence, we dispose of the present petition by permitting the petitioners to file the appropriate representation before the respondent no.2, who, on receipt of the same, will ensure that the grievance of the

petitioners is duly looked into by the competent authority in accordance with law as expeditiously as possible preferably within a period of three months from the date of receipt of the representation. The petitioners are also directed to enclose a copy of this order along with the representation.

The petition is accordingly disposed of.
