Learned advocate appearing for the petitioner submits that the present conditions imposed while granting bail to the petitioner on 24.02.2025, is creating hardship. To that effect, petitioner prays for waiver of the conditions. On the other hand, Mr. De, learned advocate appearing for the CBI submits that at least, 4/5 vulnerable witnesses are there who are required to be examined and until the said witnesses are examined, the waiver of the conditions may prejudice the prosecution.

Having considered that the case was registered in the year 2021 and petitioner was granted bail in the year 2025 and since then he is complying with the conditions, after his release, the learned Trial Court would ensure that the

vulnerable witnesses, proposed to be examined by the prosecution, be preponed.

Once the evidence of the vulnerable witnesses are over, the learned Trial court, on an application advanced by the present petitioners, would consider whether the conditions imposed while granting bail in CRM(DB) 147 of 2025 is creating hardship and thereafter would be at liberty to waive the conditions if there are no other compelling circumstances. With the aforesaid observations CRAN 1 of 2025 is disposed of.

Report submitted by the CBI be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
