State of West Bengal Mr. Arka Tilak Bhadra Ms. Paramita Mukherjee Ms.Suhana Parveen ...for the Petitioner In this application the petitioner has prayed for expeditious disposal of Belgharia Police Station Case No. 73 of 2024 under sections 498A/406 of the Indian Penal Code corresponding to G.R. No. 1261 of 2024 presently pending before learned Judicial Magistrate 2nd Court, , Barrackpore. Being aggrieved by the inordinate delay in disposal of the said proceeding, learned counsel for the petitioner submits that the instant case was initiated on 17th February, 2024 and thereafter the charge-sheet was submitted on 09.07.2024. Thereafter, in spite of expiry of about two years, the charge hearing has not been conducted by the Trial Court and the next date is fixed on 19.01.2027 for appearance.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.

Having considered the fact that the matter is pending for charge hearing for about two years, I find that the prayer made by the petitioner for expeditious disposal of the proceeding is justified and is required to be allowed for securing the ends of justice.

In view of the above, the instant application being CRR 47 of 2026 is hereby disposed of with a direction upon the court below to prepone the charge hearing and to fix a date for charge hearing in the month of July 2026 and to conclude the charge hearing on the preponed date or preferably within a month thereafter.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
