The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such service of notice of this application upon the said opposite parties is dispensed with.
The petitioner is the plaintiff of Title Suit No. 135 of 2016 pending before the 1st Court of the learned Civil Judge (Junior Division), Barrackpore, district 24-Pargahas (North).
The petitioner complains that disposal of his suit is being unnecessarily deferred due to the dilatory tactics adopted by the defendants/ opposite parties.
The Title Suit No. 223 of 2015 has been filed by the opposite parties seeking declaration of their tenancy right over the suit property.
The Title Suit No.135 of 2016 is a suit for eviction of the opposite parties from the suit property inter alia on the grounds of reasonable
requirement. The learned Trial Judge is hearing the said suits analogously Mr. Karmakar, learned advocate appearing on behalf of the petitioner informs this Court that the suit has reached to the stage of recording of evidence of P.W.1.
The Courts are slowly resuming normal functioning during this Covid-19 pandemic period. At this stage, direction upon the learned Trial Judge to dispose of any lis within a specific time is not warranted.
However, it is always desirable that considering the nature of the suit and the length of its pendency, the learned Trial Judge shall make all endeavour to dispose of both the pending suits mentioned above expeditiously and in doing so, shall not grant any unnecessary adjournment to either of the parties.
C.O. 8 of 2021 is disposed of with the above terms.
There shall be no order for costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
