The grievance of the petitioners in the present writ application is that in spite of grant of succession certificate, the respondent Bank is not releasing the amount lying in the name of the deceased Jayanta Kumar Ghosal. 2.

Learned counsel for the petitioners submits that the petitioners are the brothers of the deceased Jayanta Kumar Ghosal and after the death of Jayanta Kumar Ghosal, the petitioners have filed the succession certificate and accordingly, by an order dated June 10, 2024, the District Judge/Delegate has granted succession certificate in favour of the petitioners.

The private respondent has challenged the succession certificate granted to the petitioners by way of an application for revocation of the succession certificate but the learned District Delegate by an order dated September 10, 2025 has dismissed the said revocation application. In spite of the same, the Bank has not released the amount lying in the name of the deceased.

Learned counsel appearing for the Bank submits that the private respondent has informed the Bank that they have

filed an application for revocation of the succession certificate and as such, the Bank has not released the same as the private respondent is the nominee in the account of the deceased.

Learned counsel for the respondents further submits that as the District Delegate has granted the succession certificate, accordingly, the petitioners are required to submit the proper form and the original fixed deposit receipts in the Bank so that the Bank can take appropriate steps for release of the same.

In view of the above, this Court finds that no purpose would be served by keeping the present writ application pending.

Accordingly, WPA 239 of 2026 is disposed of by directing the petitioners to apply before the Bank in the proper format as required by the Bank and also to submit the original fixed deposit receipts to the Bank and if the Bank received the application in the proper form and the original bank receipts from the petitioners, the Bank shall take appropriate steps for release of the amount in favour of the petitioners in terms of the succession certificate obtained by the petitioners from the District Delegate. 8.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
