It has been submitted by the learned advocate for the petitioner that the next date has been fixed before the learned trial Judge on June 13, 2025 for considering the prayer for not pressing the aforesaid application.

Learned advocate for the opposite parties submits that during the pendency of the said application, the petitioner herein approached this Hon'ble Court by filing applications under Section

226 of the Constitution of India but failed to obtain any order in their favour either from the learned single Judge or from the Hon'ble Division Bench. He further submits that such fact has been suppressed by the petitioner in the application filed before the learned trial Judge.

Such submission is disputed by the learned advocate for the petitioner.

In the light of the submissions made by the learned advocate for the parties CO 17 of 2024 is disposed of by requesting the learned Civil Judge (Jr. Division), Kakdwip, South 24 Parganas, to consider the prayer of the petitioner not pressing the application under Section 151 CPC on the next date fixed, i.e., on June 13, 2025 and to dispose of such application as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
