Mr. Pintu Karar Mr. Saikat Koley Mr. Sabab Uddin Laskar ..for the petitioner Mr. Tapan Kumar Mukherjee Mr. Suman Dey ..for the Council Mr. Bhaskar Prasad Vaisya Mr. Nilay Baran Mandal ..for the State respondent On January 4, 2024 when this writ petition was taken up for hearing, this Court passed the following order:- "The petitioner intends to set up a D. Pharm College. Admittedly, the petitioner received "consent of affiliation" from the West Bengal State Council of Technical & Vocational Education and Skill Development.

However, subsequently, the said council declined to accord approval on the ground that the

college does not have required number of faculty members.

Mr. Pintu Karar, learned advocate appearing for the petitioner has drawn attention of this Court to an e-mail dated December 30, 2023, whereby the council communicated to the petitioner that it desires to cause a second inspection and may grant affiliation to the college for the year 2023, if all the deficiencies are found to be complied with as per documents and inspection report.

Mr. Karar, learned advocate appearing for the petitioner submits that the college has the required number of faculty members. Unfortunately, on the date of inspection, one teacher namely, Somnath Roy was absent due to health issues.

Mr. Mukherjee, learned advocate representing the council submits that if the college is found suitable for affiliation, the last date of admission shall automatically be extended.

At this juncture, no further order needs to be passed. The council shall cause the second inspection within one-week from date."

Today, it has been jointly submitted by the parties that after the second inspection conducted by

respondent no.4, the college was found fit for affiliation for the academic session 2023-2024.

Accordingly, the council has already granted provisional affiliation to the petitioner/college by an order dated January 4, 2024.

It is the stand of the council that if the college is found suitable for affiliation, the last date of admission shall be extended. Therefore, the Council will extend the last date of admission till January 30, 2024 for the current academic session.

Nothing more needs to be decided in this writ petition.

Accordingly, WPA 128 of 2024 is disposed of.
