Mr. Subhendu Banerjee, learned Advocate for the petitioner submits that the petitioner is an applicant in respect of the vacancy notification dated 26th March, 2022 for filling up of a vacancy of fair price shop dealership in Kalikapur, South 24-Parganas. Though inspection has been held but till date the application of the petitioner has not been processed. Hence, the petitioner is constrained to file the present writ petition praying for appropriate order for expeditious disposal of the application of the petitioner for grant of licence.

Mr. Suman Sengupta, learned Advocate for the State-respondents submits that direction may be passed upon the respondent no.5 being the Sub-Divisional Controller, Food & Supply, Government of West Bengal, Baruipur, South 24-Parganas for processing the applications submitted in respect of the vacancy notification dated 26th March, 2022.

Upon hearing the learned Advocates for the respective parties, the respondent no.5 being the SubDivisional Controller, Food & Supply, Government of West Bengal, Baruipur, South 24-Parganas is directed to process the applications submitted by applicants including the application of the petitioner for filling up of vacancy of fair price shop dealership in respect of the vacancy notification being Memo No.371/SC/FS/BRP/ FPS/VACAN/22 dated 26th March, 2022 expeditiously, preferably within a period of two months from the date of communication of this order, in accordance with law. In light of the above observations, the writ petition being W.P.A. 132 of 2024 stands disposed of.

Petitioner is directed to communicate this order to the respondent no.5.

Since no affidavit-in-opposition is invited, all allegations made in the writ petition are deemed to be not admitted.

It is made clear that this Court has not gone into the merits of this application.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
