Learned advocate appearing for the petitioner submits that there has been no recovery from the possession of the present petitioner and the petitioner has been arrested only on the basis of statement of co-accused from whom 400 bottles of Phensedyl was recovered. It has been submitted that the petitioner is in custody for 78 days. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the subject-matter of the investigation relates to recovery of commercial quantity of contraband.

Having considered that the investigation of the case is still in process, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after the charge-sheet is submitted before the jurisdictional court. The application for bail, being CRM (NDPS) 36 of 2026, is, thus, dismissed.
