Petitioner claims that he is the owner of a land where he is being obstructed with deadly weapons from entering at the behest of the private respondents. To that effect, complaint has been lodged before the Inspector-in-Charge as well as the Superior Officers of the Police.

Report has been submitted by the state.

Report reflects that the police authorities have drawn up proceedings under section 107 of the Code of Criminal Procedure.

Learned advocate submits that till date he has not been able to enter the property.

Be that as it may, petitioner will submit a fresh complaint as more than 1 year has passed since 20.11.2023, when the information was furnished.

In case the petitioner is in possession of documents and intends to enter, the police authorities will render all possible assistance. In case there is any untoward incident, police authorities would seek assistance of the SubDivisional Officer for the purposes of ascertaining regarding the document which is correct so far as the petitioner and private respondent is concerned. Petitioner will also inform the Superior Authorities of the Police of the district of Murshidabad 48 hours ahead of time when he intends to visit his property.

With the aforesaid observations WPA 134 of 2024 is disposed of.
