The petitioner is aggrieved by the progress of Ghola P.S. Case No. 384 of 2024 dated 23.12.2024. Learned advocate for the petitioner submits that the said case was registered on the basis of a direction passed by learned jurisdictional Magistrate as initial information furnished to police
authorities failed to yield any result.
Additionally, the grievance of the petitioner is that petitioner is dissatisfied regarding progress of investigation since effective steps have not been taken and prays before this Court for a direction upon the investigating agency to diligently conduct the said investigation.
A report has been submitted by the State, which reflects that there are cases and counter-cases between the present petitioner and private respondents.
The report also reflects that over trivial issues, disputes and differences cropped up and, thereafter, the same was blown out of proportion and, in fact, at the behest of the private respondents, Barrackpore Women P.S. Case No. 108 of dated 23.11.2024 has been
registered.
The report also speaks that the investigation in respect of both the cases are in progress. The police authorities expect that within the stipulated period, the report under Section 193 of the BNSS would be filed before learned jurisdictional Court.
Learned advocate for the private respondents submits that it was the private respondents who has set the law into motion and as a counter-blast, the present case has been initiated at the behest of the petitioner.
Be that as it may, the police authorities have, in their report, expressed the intention regarding the steps which are being taken for the progress of the investigation and for submitting their report in final form within the stipulated period of
time.
As the petitioner has approached this court regarding the lack of diligence on behalf of the police authorities for effectively not conducting the investigation, I direct that in order to take the investigation to its logical conclusion, the police authorities would collect available materials, assess regarding the issues canvassed and address the same before submitting their report under Section 193 of the BNSS, 2023.
With the aforesaid observations, WPA 261 of 2025 is disposed of.
Report so submitted be kept with the record.
