1. The appellant is not represented. Administrative notice was issued in terms of the order dated 28.8.2025. It appears that the administrative notice was sent on 29.8.2025.

2. We have perused the order under appeal. The appeal is arising out of an order dated 05.12.2023. The appeal was filed on 10.01.2024. However, the appeal was not pursued. Learned Trial Court has not accepted the prayer of the defendant over construction in absence of the defendant establishing their possession of any specific portion of the suit property in which they intend to make construction. We feel that the order of status quo, the impugned order does not suffer from any infirmity.

3. However, we request the learned Trial Court to dispose of the suit as expeditiously as possible.

4. Since the appellant is not represented, department is directed to communicate this order to the learned Civil Judge, Senior Division, Lalbagh, Murshidabad for information.

5. The appeal and the application are accordingly disposed of. (Soumen Sen, J.) (Apurba Sinha Ray, J)
