Sunil Handa @ Sunil Kumar Yanda .... petitioner Mr. Soumyajit Das Mahapatra ....for the petitioner Mr. Swapan Banerjee, Mr. Anindya Sundar Chatterjee ..... for the State Apprehending arrest in connection with Kharagpur (Town) Police Station Case No.212 of 2021 dated 06.05.2021 under Sections 153A/295A/505(2) of the Indian Penal Code, the present application has been preferred.

Mr. Das Mahapatra, learned advocate appearing for the petitioner submits that the petitioner could not comply with the earlier direction of this Court since another case has been instituted against him. Such contention of Mr. Das Mahapatra is not acceptable to us.

Mr. Banerjee, learned advocate appearing for the State submits, upon instructions, that in spite of earlier direction of this Court the petitioner has neither met with the Investigating Officer nor did cooperate with the investigation. Let the report, as produced, be kept with the record.

It thus appears that the petitioner has not complied with our earlier direction. Considering the nature of accusations and the petitioner's conduct, we are not inclined to exercise any

discretion in his favour and as such, his prayer for anticipatory bail is refused.

Accordingly, the application for anticipatory bail being C.R.M.(DB) No. 19 of 2022 is dismissed.
