None appears on behalf of the parties either virtually or physically on call.

It is reported by the Department vide Office report dated August 10, 2021 that two appeals being S.A. 361 of 1972 and S.A. 362 of 1972 which were directed to be heard analogously with the present appeal have already been dismissed.

In view of such position, the present second appeal cannot survive independently.

Therefore, S.A. 91 of 1975 is dismissed without any order as to costs.

Department is directed to send down the Lower Court Records to the concerned Court immediately. Urgent certified copy of this order, if applied for, be supplied to the parties subject to compliance with al requisite formalities.
