The land of the petitioner was acquired by the Union of India for construction of road and bridges under Section 3A(1) of the National Highways Act, 1956 (hereinafter referred to as the 'said Act' in short). The petitioner is aggrieved by the amount determined by the competent authority on account of compensation for such acquisition.
The petitioner by the instant writ petition is praying a direction upon the respondent authorities to take immediate steps for appointment of an arbitrator. Sub-section (5) of Section 3G of the aforesaid Act contemplates that if either of the parties is not satisfied with the amount of compensation determined by the authority may apply to the Central Government
for appointment of an arbitrator. The said course is always open for the petitioner.
The writ petition is dismissed as misconceived. No order as to costs.
