Petitioner is aggrieved by the fact that in spite of 07.07.2025 Court No. 35 M/L.
No.1449 Rakib the learned Civil Judge (Junior Division), 1st Court, Uluberia being in seisin of Title Suit No. 367/2027 and a direction having been passed under Section 151 of C.P.C., the police authorities did not take any steps, rather the compliance report of the police report are against the spirit and purpose of which the Civil Suit was preferred. Further grievance of the petitioner is that on 02.01.2025 petitioner submitted a representation to the Rajapur Police Station, Howrah wherein it was alleged that unknown persons forcefully tried to trespass and encroached the land by flouting the injunction order and tried to attack the petitioner for inflicting injuries. State has submitted a report, the report is dated 07.01.2025. Report reflects that although Civil Suit was pending but Government work was being carried out at Dag no. 62 which belongs to the Irrigation Department, Government of West Bengal.
Be that as it may, the main grievance of the petitioner right now is that there are overt acts at the behest of unknown persons who are trying to forcefully trespass and occupy the land. Since the Civil Suit against the specific persons and unknown miscreants have been named by the present petitioner, police authorities would assess, ascertain regarding the whereabouts of the unknown persons and if they find that any offence has been committed they would take steps in accordance with law.
With the aforesaid observations WPA 162 of 2025 is disposed of.
Report submitted by the State be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioner.
