Mr. Debnath, learned advocate appears on behalf of appellant and submits, leave be granted to take back certified copy of the order impugned upon replacing the same with a photostat copy, to enable his client to prefer revision against the order of dismissal of suit made under order XXIII, Code of Civil Procedure, 1908. The appeal is dismissed as not maintainable.

Leave is granted to appellant to take back the certified copy on furnishing a photostat copy thereof. Appellant will be at liberty to contend exclusion of time in event a revision petition is preferred.

FMA 880 of 2016 is dismissed.
