Mr. Milon Mukherjee, Sr. Adv Mr. Duttatreya Dutta ...for the petitioners. Mr. Neguive Ahmed Ms. Amita Gaur ... for the State. Mr. Mukherjee, learned senior advocate appearing for the petitioners prays for leave to correct the cause title. Such prayer is considered and allowed. The learned advocate-on-record of the petitioners is granted leave to effect necessary correction in the cause title.

Drawing the attention of this court to the averments made in the application for bail, Mr. Mukherjee submits that the petitioners have been falsely implicated in the instant criminal proceedings. Upon completion of investigation, charge-sheet has already been filed on 29th November, 2020 and the petitioner is in custody for 128 days. The learned advocate appearing for the State respondents denies the contention of the petitioner and submits that the petitioners are involved in the alleged offences.

Upon considering the materials in the case diary, the nature of allegations and the extent of complicity of the petitioners in the alleged offences, we are of the opinion that further detention of the petitioners is not necessary and we are inclined to grant bail. Accordingly, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees ten thousand only) each

with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Paschim Bardhaman at Asansol and subject to a further condition that the petitioners shall appear before the Officer-in-Charge, Chittaranjan Police Station twice a week on and from 15th January, 2021, until further orders.

Accordingly, the application for bail, being CRM No. 86 of 2021, is allowed.
