Learned advocate appearing for the petitioner submits that the petitioner stands in the same footing as that of the co-accuseds who were granted bail by the coordinate Bench in CRM 9028 of 2021 on December 30, 2021. Learned advocate appearing for the State submits that the petitioner herein is the part of the group of persons who were sending electronic mails to the unsuspecting members of the public promising them of jobs as home guards in lieu of money. He submits that State approached the Legal Remembrancer for the purpose of applying for cancellation of bail granted by the order dated December 30, 2021 in CRM 9028 of 2021.

Considering the gravity of the offence and considering the fact that case diary in respect of Nabagram Police Station Case No. 154 of 2021 was not produced

before the Court for consideration by the co-ordinate Bench while granting bail on December 30, 2021 in CRM 9028 of 2021 and considering the fact that State is applied before the legal Remembrancer for the purpose of cancelling/ recalling of the order dated December 30, 2021 passed in CRM 9028 of 2021, we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected. CRM (DB) 30 of 2022 is dismissed.
