AGP Mr. Asish Dutta ... for the State-respondent(s) The petitioner is aggrieved by the fact that initially he lodged a complaint for which Chakdah P.S. Case No. 895 of 2023 was registered for investigation. On completion of investigation, charge-sheet was submitted before the learned jurisdictional court under Sections 341/506/34 of the IPC.

The petitioner further complains that he was threatened, but, no action has been taken by the police authorities.

State has submitted a report, which reflects that pursuant to the information furnished to the police authorities on 11.02.2024, a proceeding

was drawn up under Sections 107/116(C) of the Cr.P.C.

against the private respondents.

In view of the nature of the accusation for which case was initiated and the charge-sheet submitted, the petitioner would be at liberty to approach the jurisdictional court under the relevant provisions of law, if he is aggrieved by the outcome of the investigation.

If the petitioner approaches the learned trial Court for necessary protection as a witness in the charge-sheet submitted in connection with Chakdah P.S.

Case No. 895 of 2023, the learned Magistrate would call for a threat perception report and, after considering such report, pass necessary orders/directions upon the police authorities to give protection to the petitioner.

Since the petitioner and the private respondents are at loggerheads,

the police authorities would ensure that no breach of peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 316 of 2025 is disposed of.
