It appears from the said report that on examination the Lower Court Record was found complete way back on Mach 21, 1980 although the Paper Book was filed on April 01, 1985. No steps thereafter were taken by the appellant for disposal of the appeal.

The appeal is pending since 1977. It is, therefore, apparent that the appellant has lost his interest in pursuing the present appeal.

S.M.A. 59 of 1977 is, therefore, dismissed.

Department is directed to send down the Lower Court Records immediately.
