Sarkar ...For the Respondents It is submitted on behalf of the petitioner that an appeal has been pending since October 26, 2022 with the Director General, Border Security Force (BSF).

Ms. Chakraborty, learned counsel appears on behalf of the respondents.

This Court is of the view that the statutory appeal cannot be kept pending indefinitely. Already, six months have lapsed from the date of filing of the appeal. Let the said appeal be disposed of by the Director General within two months from the date of the order. With the directions aforesaid, W.P.A. 144 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the petitioner are deemed not to have been admitted by the parties.

Needless to mention that the reasoned order to be passed in the appeal shall be communicated to the petitioner within two weeks of passing of the order.

All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
