There was recovery of 194 bottles of phensydl from possession of the petitioner and another. So far as the other accused person is concerned, he has already been released on bail. Learned advocate for the State submits that charge has been framed and the trial has commenced.

I have taken into account the locus of the petitioner along with other the accused person and the period of detention (1 year 10 months) of the petitioner.

Having considered the same, I am of the opinion that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, MD. Sabir Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty

Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, 6th Court, Barasat, 24 Parganas (North). If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of 24 Parganas (North) without the prior permission of the learned special court.

Accordingly, CRM (NDPS) 40 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
