On the prayer of learned counsel for the petitioner, the petitioner is directed to file affidavit-of-service during the course of the day.

It transpires that a copy of the application has been sent to the respondents.

In any event, the respondents were also absent when the appeal was dismissed for default.

Accordingly, CAN 6 of 2024 is taken up for hearing without further notice to the respondents.

Being satisfied that sufficient reasons have been shown for the absence of the appellant/petitioner on the relevant date, CAN 6 of 2024 is allowed, thereby recalling the order dated November 7, 2024 and restoring FA 14 of 2020 to its original file and number.

The appeal shall now be listed for hearing on November 20, 2024.
