Kausik (Allowed) CRM (M) 78 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chakdah Police Station Case No. 1470 of 2025 dated 5th December, 2025 under Section 69 of the BNS, 2023.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 55 days and there was a relationship existing between the petitioner and the victim. Both of whom are students of an engineering college. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim girl/lady under section 183 of the BNSS. Learned advocate for the defacto-complainant opposes the prayer for bail.

I have taken into account the overall circumstances of the present case and is of the view that although a case is made out for trial but custodial detention is not necessary. Having regard to the same, petitioner be released on bail.

Petitioner, namely, Sunirmal Shikari shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Kalyani.

If on bail petitioner shall be physically present on each and every date fixed by the learned Court in seisin of the case and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Trial Court/ACJM, Kalyani. Accordingly, CRM (M) 78 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
