The application being CAN 2 of 2024 is taken out for recording fact relating to reconstitution of the Board of Rail Vihar Cooperative Housing Society based on the election held on 18th February, 2024 wherein out of 14 members elected, one of the members namely Sanghamitra Ghosh was the member of erstwhile nominated board.

Mr. Ashit Kr. Chakraborty, learned advocate representing the applicant submits that inadvertently it was submitted before the Court at the time of disposing of the writ petition by passing order dated 1st May, 2024 that all the 14 members of the Board were elected based on the election dated 18th February, 2024 are new members and no member of the erstwhile nominated

Board was elected to function as member of reconstituted Board.

In view of averments made in paragraphs 3 and 4 of the present application the order passed by this Court dated 1st May, 2024 stands modified to the extent that one of the members of the erstwhile nominated Board of the society was elected to function as one of the 14 members of the present Board.

Rest of the observations and directions as contained in the order dated 1st May, 2024 remains unaltered.

Accordingly, the application being CAN 2 of 2024 stands disposed of.
