Kutub Uddin ..........for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Nandakumar P.S. Case No. 505/2021 dated 22.11.2021 under Sections 498A/304B/34 of the Indian Penal Code.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that the alleged incident occurred within one year three months of the marriage.

Considering the nature of accusations, the gravity of the offence and the extent of complicity of the petitioner, we are not inclined to exercise any discretion in his favour, moreso when investigation is still continuing. As such, the petitioner's prayer for bail is refused at this stage. The application CRM (DB) 28 of 2022 is, accordingly, dismissed.
