Kausik (Allowed) CRM (M) 74 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 678 of 2024 dated 02.07.2024 under Sections 329/118/117(2)/109/303(2)/3(5) of the BNS, 2023 adding Sections 103(2)/303(2)/427 of the BNS, 2023.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 3 months and 20 days and the charge sheet has already been submitted before the jurisdictional Court. It is further contended that similarly placed accused person has been granted bail.

Learned advocate for the State opposes the prayer for bail but is unable to rebut the issue that the petitioner is similarly situated as other accused persons who have been granted bail in CRM (M) 417 of 2025 and CRM (M) 1763 of 2025.

Having regard to the same, I am of the view that further detention of the petitioner is unwarranted.

As such the prayer for bail of the petitioner is allowed. Petitioner, namely, (1) Md. Aminul Islam @ Aminul Hoque, (2) Milan Sk. @ Milon Sk. shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Lalbagh, Murshidabad.

If on bail petitioner shall be physically present on each and every date fixed by the learned Court in seisin of the case and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned ACJM, Lalbagh, Murshidabad.

Accordingly, CRM (M) 74 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
